These Terms & Conditions (“Terms”) govern your use of our website https://forestline.co.ke (the “Site”), the booking of tour packages, and the purchase of related services. By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Site or services.
1. Definitions
- “Customer,” “you,” “your”: any person or entity using the Site to browse, book, or purchase services.
- “Booking”: the reservation of a tour package through our Site.
- “Tour Package”: any travel, tour, accommodation, or related services provided by us or our third-party suppliers.
- “Services”: collectively, the Tour Packages and any other travel-related services offered on the Site.
2. Eligibility
You must be at least 18 years old to make a Booking. By making a Booking, you represent and warrant that you have the legal capacity to enter into these Terms and to perform all obligations hereunder.
3. Booking Process
- Selection: Browse available Tour Packages and select your desired itinerary and dates.
- Payment: Choose to pay in full or a 50% deposit.
- Confirmation: Upon successful payment, you will receive a Booking confirmation via email containing your Booking reference, itinerary, and payment details.
All Bookings are subject to availability and confirmation by us.
4. Payment Terms
- Deposit Option: A 50% deposit is required to secure your Booking; the remaining balance is due no later than 14 days prior to departure.
- Full Payment Option: Pay 100% of the Tour Package cost at the time of booking.
- Payment Methods: We accept major credit/debit cards and bank transfers.
- Currency: All prices are quoted in United States of America Dollars (USD), unless otherwise stated.
Failure to pay the remaining balance by the due date may result in cancellation of your Booking, subject to our Refund & Return Policy.
5. Changes & Cancellations
Your rights to change or cancel a Booking and any applicable fees are governed by our Refund & Return Policy, incorporated herein by reference. See Section 7 for the link.
6. Travel Documents & Health Requirements
You are responsible for obtaining all required travel documents (passports, visas) and complying with health requirements, including vaccinations. We assume no liability for delays, losses, or costs incurred due to your failure to obtain such documents or meet health requirements.
7. Travel Insurance
We strongly recommend that you obtain comprehensive travel insurance covering trip cancellation, medical expenses, personal injury, and personal liability. You acknowledge that you have been advised to obtain such insurance and that failure to do so is at your own risk.
8. Liabilities & Disclaimers
- Third-Party Suppliers: Some Services are provided by third-party suppliers. We act only as an agent for these suppliers. Their terms and conditions may apply. We do not accept liability for their acts or omissions.
- Force Majeure: We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, strikes, or government restrictions.
- Limitation of Liability: To the fullest extent permitted by law, our total liability under these Terms shall not exceed the total amount paid by you for the relevant Tour Package.
9. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Forestline Tours and Travel Company Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute any content without our prior written consent.
10. Privacy & Data Protection
Your use of the Site is also governed by our Privacy Policy, which is incorporated herein by reference. Please review it to understand how we collect, use, and share your personal data.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Amendments
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on our Site with a revised “Last Updated” date. Continued use of the Site after such changes constitutes your acceptance of the updated Terms.
